Our specialist abuse team, led by Elizabeth Duncan, recently achieved a £15,000 settlement for a young woman (referred to here simply as J for confidentiality reasons) who was sexually assaulted by a fellow pupil while a young child in primary school.
J’s story
J joined the school at the age of 5. From an early stage, she was subjected to repeated incidents by another child, who was able to follow her to isolated areas of the school, including the toilets, where he assaulted her. This happened during both lessons and break times with an incident also taking place in the playground.
After some time J was able to tell her parents what had happened and a safeguarding referral was made. However ongoing concerns about the adequacy of the school’s supervision and protective measures meant that J’s parents reached out to our abuse team to consider legal options.
Elizabeth considered what had happened and agreed to help with a claim for compensation against the school on a No Win No Fee basis. The claim was brought against the local authority which owned and operated the school on the basis that their staff had failed to supervise these very young children adequately.
The school denied it was at fault, maintaining that its safeguarding arrangements were appropriate. The case was further complicated by significant delays by the school in the disclosure of important documents.
Despite these challenges, Elizabeth continued to pursue the case with persistence, empathy and determination. Through careful negotiation, a settlement of £15,000 was secured before court proceedings became necessary.
